Plain English, and it says what actually happens. If anything here reads as a trick, it is badly written and we want to know.

"We", "us" and "our" mean Kavalsia Inc. "You" means the person buying or using the service. By buying or using it you agree to these terms.

2. You must be an adult

You have to be 18 or older and able to enter a contract to buy from us. The game is designed for a parent or guardian to set up and for a child to play with an adult nearby. Do not buy this on behalf of a child who is doing the buying themselves.

3. What you are actually buying

You are buying a licence to use a link that opens a birthday game you built, together with the planner for that same party. You are not buying software or a download.

The price covers one party. Paying for a party unlocks its game link and its planner at the same moment: the guest list, the invitations, the shopping list and the run sheet. There is no second price for the planner and nothing on this site sells it separately.

One party costs $39, and it is charged once. The link never stops opening. There is no subscription, no renewal and nothing to cancel.

Where the site offers a pack, a pack is one payment that covers more than one child's party. It is not a bulk licence and it is not shared: each child gets their own party, built separately, on its own link, and every one of those links behaves exactly like a party bought on its own. Buying more than one party in a single payment costs less than buying them one at a time, and that is the only difference.

A pack is not a credit balance and it does not expire. You do not have to know whose birthdays they are when you buy it. A party is taken from the pack at the moment you make that party, so the second child's birthday can be months later, and a pack you have not finished does not run out.

What you are holding, exactly. The whole game lives inside its own web address, which is why the link is the thing you are buying. Nothing we sell has an end date written into it, so the link you send is intended to keep opening indefinitely. Keep the link, or the party saved as a file from the builder, and you keep the party.

3a. Your account

You can keep your parties in an account so they follow you to another phone. Creating one carries no charge and asks for no card. It asks for an email address and a password. There is no card on file, no trial, and nothing that starts charging you later.

An account is a convenience, not the product. You can build a game, preview it and buy a link without ever making one, and a link you already hold keeps working whether you have an account or not.

Read this before you choose a password. The key that opens your parties is worked out from your password inside your own browser and is never sent to us. That is what lets us say we cannot read what you store. It also means we cannot reset it for you, and a lost password loses the parties held in your account. We have nothing on our side to recover them with.

Two copies survive that, and we say so on the day you buy: the link itself, which carries the whole party and keeps working until its own end date, and the party saved as a file from the builder. Keep at least one.

You are responsible for what happens under your account, for keeping your password to yourself, and for the accuracy of the email address you give us. Tell us if you think somebody else is using it.

We may close an account that has been dormant for two years, after emailing the address on it first. You can close yours at any time by emailing us, and we delete what we hold within 30 days.

4. The preview

You can build a complete game and play a preview before paying anything. The preview link lasts 60 seconds and is intended to let you check the game before deciding. It is not a licence to run a party.

5. Payment

Prices are shown at the checkout. Payment is taken by Stripe; we never receive or hold your card number.

The $39 price is charged once and there is nothing to cancel. Your card is charged one time, for that one party. We do not keep it on file and there is no renewal to stop.

A pack is charged once too, as a single payment at the price shown for it, and it is the same kind of charge: one time, no card kept on file, no renewal to stop. There is no per-party charge afterwards and no second payment when you make the second party.

Where the site shows a higher price struck through beside the one you pay, the struck number is not charged and never has been. The amount you are charged is the amount at the checkout, and it is the amount named in this section.

Prices are exclusive of any sales tax that applies where you are, which the checkout will add and show you before you confirm.

6. Nothing you buy here runs out

We do not sell a timed link. What you pay for is intended to keep opening, and there is no date at which we stop it.

If you are holding a link from an earlier price, when we did sell timed and monthly ones, it still behaves the way it did when you bought it and the terms you bought under still apply to it. Email # and we will tell you what you are holding.

Nothing on this site charges you automatically. There is no subscription to cancel, no card kept on file and no renewal. That is true of a pack as well: a pack is one payment, every link it produces keeps opening, and there is nothing in it to renew.

7. Refunds

Because you can build and preview the entire game before paying, and because what you receive is delivered immediately, refunds work as set out in the refund policy, which forms part of these terms. In short: email us within 14 days and we will refund you.

A pack that has already made a party is not refundable. A party is delivered the moment you make it, and a pack is a payment for parties. Once a pack has produced a party, the pack is not returned, in whole or in part. A pack you have not made any party from is refunded like anything else on this page, inside the 14 days. This does not affect your statutory rights, which the refund policy sets out in full.

8. Your content

The names, ages, challenges and gifts you type in are yours. We claim no rights over them.

If you keep a party in an account, a copy of it does reach us, and it reaches us locked with a key we never hold. We cannot read it, so we could not use it if we wanted to. The privacy policy lists exactly what sits on our server and what does not.

You are responsible for what you write. Do not use the service to write anything that harasses, threatens, sexualises or endangers a child or anyone else. Because what you write is locked before it reaches us, we cannot moderate it, which makes this your responsibility entirely.

9. Our content

The challenge library, the artwork, the code and the design are ours and are licensed to you for personal, non-commercial use with your own family and friends.

You may not resell the service, run it as a paid activity for other people's children, scrape or bulk-generate links, or strip our name off it and present it as your own. If you want to use it commercially, email us; the answer is not automatically no.

10. Play safely

The game asks children to do physical things: planks, jumping jacks, spinning, balancing, carrying somebody, holding an ice cube. A responsible adult must be present and must use their judgement.

Skip anything that is not right for the child, the room or the day. Every challenge can be skipped, and you can remove or rewrite any of them before you send the game. You are responsible for supervising play. We are not liable for injury arising from choosing to do a physical challenge.

11. Availability

We try to keep the site up but we do not promise uninterrupted availability. Because the game travels inside your own link rather than being fetched from us, a game you already have keeps working even if our website is down. Signing in, saving a party to your account and reading replies do need the site, and those stop while it is down.

12. Liability

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited by law. Your statutory consumer rights are not affected.

Subject to that, the service is provided as it is, and our total liability to you is limited to the amount you actually paid us. We are not liable for indirect or consequential loss, or for a party not going the way you hoped.

13. Ending it

You can stop using the service at any time, and you can ask us to close your account and delete what we hold. We may suspend an account if the service is being used in breach of section 8 or 9. If we do that without cause, we refund you. Suspending an account does not switch off a link you already hold, because we have no way to reach into a link.

14. Changes to these terms

We may update these terms. The version that applies to your purchase is the one published on the day you bought. We will not change the terms of a purchase you have already made.

15. Law and disputes

These terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you are a consumer somewhere else, this does not take away the protection of the mandatory laws of the country you live in.
